El presente artículo expone una redescripción de la primera persona gramatical en términos de su funcionamiento lógico-pragmático: qué ─acción─ cuenta como práctica lingüística de enunciación de “yo” como operación anafórica. Para conseguir este propósito, se utiliza la noción de anáfora como vínculo inferencial con estructuras suboracionales substituibles, y estas a su vez con estructuras proposicionales articuladas inferencialmente. Además, se cuenta con la noción de juegos de lenguaje y formas de vida ─Lebensformen─ en tanto adiestramiento para la práctica de dicho jugador. (...) Prisoners sometimes die in prison, either due to natural illness, violence, suicide, or a result of imprisonment. The purpose of this study is to understand deaths in custody using qualitative methodology and to argue for a comprehensive definition of death in custody that acknowledges deaths related to the prison environment. Interviews were conducted with 33 experts, who primarily work as lawyers or forensic doctors with national and/or international organisations. Responses were coded and analysed qualitatively. Defining deaths in custody according to (...) the place of death was deemed problematic. Experts favoured a dynamic approach emphasising the link between the detention environment and occurrence of death rather than the actual place of death. Causes of deaths and different patterns of deaths were discussed, indicating that many of these deaths are preventable. Lack of an internationally recognised standard definition of death in custody is a major concern. Key aspects such as place, time, and causes of death as well as relation to the prison environment should be debated and incorporated into the definition. Systematic identification of violence within prison institutions is critical and efforts are needed to prevent unnecessary deaths in prison and to protect vulnerable prisoners. (shrink)

The accuracy of proxies when they interpret advance directives or apply substituted decision-making criteria has been called into question. It therefore became important to know if the Andalusian Advance Directive Form (AADF) can help to increase the accuracy of proxies' predictions. The aim of this research was to compare the effect of the AADF on the accuracy of proxies' predictions about patients' preferences with that gained from informative and deliberative sessions about end-of-life decision making. A total of 171 pairs of (...) patients and their proxies were randomized to three groups. The control group's answers to the Life Sustaining Preferences Questionnaire (LSPQ) were compared with their proxies' answers to the same questionnaire. In one intervention group, the patients had already completed the AADF and given it to their proxies, who used it to guide their own answers to the LSPQ. In the second intervention (discussion) group, both patients and proxies attended two educative sessions guided by trained nurses and later filled in the LSPQ. Comparisons of accuracy and other variables showed a strong association with the discussion group. The findings show that promoting communication between patients and their proxies improves the accuracy of proxies' predictions much more than isolated use of the AADF form. (shrink)

Objective: To measure the stability of life-sustaining treatment preferences amongst older people and analyse the factors that influence stability. Design: Longitudinal cohort study. Setting: Primary care centres, Granada (Spain). Eighty-five persons age 65 years or older. Participants filled out a questionnaire with six contexts of illness (LSPQ-e). They had to decide whether or not to receive treatment. Participants completed the questionnaire at baseline and 18 months later. Results: 86 percent of the patients did not change preferences. Sex, age, marital status, (...) hospitalisation, and self-perception of health and pain did not affect preferences. Morbidity and the death of a relative did. Conclusion: Stability of preferences of older persons in relation to end-of-life decisions seems to be more probable than instability. Some factors, such as the death of a relative or the increase in morbidity, can change preferences. These findings have implications for advance directives (ADs) and advance care planning. (shrink)

This idea is developed along the lines of pragmatism which holds that a set of beliefs is a matter of linguistic evaluation from a particular community. This notion is related to the idea of facts as empirical information that is cognitively apprehended. Such information is regarded as an input which is later contrasted to expected behavioral (...) responses from the agent. The deviation of such observed behavior with respect to the expected one represents an evaluative output that is understood as the definition of reasonably expected behavior. ABSTRACT In this article we analyze the attempt that young Simone Weil made for thinking time and change, and for deciphering the participation that the world and the mind may have in its configuration. To achieve this, we set out to elucidate two concepts that we believe synthesize her approach: the first one is astonishment, understood both in its quality of incessant intuition that reveals the human impotence to understand the present, and in its quality as a mediating instance between (...) ignorance and approximate human science of the phenomenal field. The second concept we analyze is that of directed time, significant of the first Weilian philosophy in that it reveals the subjugation of man to the present, the only tangible time. This determination allows us to understand the meaning of the past as an abolished existence, and the future as a virtual nucleus of possibilities towards which the human being prepares his action and work thanks to his faculty to devise projects. Finally, we try to show the problematic tension that young Weil discerned between the law of the immediacy of the world, and the law of time that imposes intermediate steps to the realization of all human activity. Ahora bien, nuestra intención es mostrar que si bien es cierto que la concepción del tiempo de S. Weil, en sus (...) años de madurez, se erige desde una perspectiva espiritualista, mística y religiosa, en su primera época la filósofa se instala en una ontológica fuertemente influenciada por Kant, que la lleva a restringir lo temporal al marco de la experiencia posible, en el sentido que le da el pensador alemán.The question of time is one of the most important subjects in Simone Weil’s philosophy. Indeed, time’s issue is intensively present in her works from her earlier texts until her last writings. This can be explained by the fact that, for this author, it is through time that we can access to reality and find any sense into the latter. That being said, our goal is to show that, if certainly it can be affirmed that S. Weil’s conception of time in her maturity years is constructed from a spiritual, mystic and religious perspective, at the opposite, in her first period, the philosopher settles her views through an ontology strong influenced by Kant, which conducts her to limited temporal matters into the frame of possible experience, according to the definition of this expression given by the German thinker. A partir de nuestra interpretación de la obra de Simone Weil proponemos dos líneas de lectura para entender su concepción de la identidad individual: primero, mostramos que para la filósofa el hombre construye, a través de su trabajo, la imagen de sí mismo que él busca ser. Mostraremos que esta búsqueda está habitada por un problema fundamental: la repetición de un mecanismo ligado al deseo de expansión del yo, en el que apenas se alcanza el instante de contacto con la (...) imagen proyectada, esta se ve remodelada y vuelta a lanzar al horizonte inalcanzable del deseo. Así, veremos en segundo lugar que en oposición a ese camino de construcción de la identidad que emana de la labor, aparece en la última época weiliana una búsqueda de destrucción del impulso de identificación, que implica una disciplina consciente de control de la expansión del yo y del deseo de poder que le es inherente. From our interpretation of Simone Weil's works, we propose two lecture lines to understand her conception of individual identity: first, we show that, according to Weil, man builds, through his work, the image of himself that he attempts to be. We will show that, behind this search, there is a structural problem: the repetition of an mechanism related to the self's desire of expansion, where, as soon as the instant of contact with the projected image is reached, this image is remodeled and launched forward until the unreachable horizon of desire. And secondly, we will see that in opposition to this path of identity's construction which arises from work, in the last weilian period it appears a search of destruction of the identification momentum, that implies a conscious discipline of control of the self's expansion and the desire of power which is related. In lieu of an abstract, here is a brief excerpt of the content:Toward a Political Economy of the Libro De AlexandreSimone Pinet (bio)The carefully composed and craftily pronounced stanzas of the thirteenth-century Libro de Alexandre, if mostly a (free) translation of Gautier de Châtillon’s Alexandreis, provide readers with glimpses of northern Iberia in descriptions and comparisons, but especially through curious formulations and eloquent rewritings.1 These incite the reader to reflect upon the emergence of the vernacular regime of literary composition by (...) clerics that developed in the thirteenth century, a corpus known to us as the mester de clerecía. In this corpus, the use of the vernacular, in particular, brings with it an unproblematized sense of transparency of the context in which the works of mester de clerecía were produced, a genre of which the Libro de Alexandre is a key poetic point of origin. Next to an emphasis on a Latinate syntax and recitation techniques that underline the corpus’s clerical production, the irruption of quotidian phrases, vocabulary, figures of medievalization, and especially of Iberization, make these texts a privileged site to study the articulation of the varied phenomena that from economics to the grammatical, from Aristotle to technology, come to revolutionize medieval culture from the twelfth century onward. Of the many peculiar uses of the vernacular in the Libro de Alexandre, references that connote a sense of worthlessness through the repeated structure “not worth an X, ” especially those that express the comparison with minted coinage of little value: dinero, meaja, pepión, or sueldo, as in “not worth a penny,”2 will serve here as a point of entry. We are partial to people with whom we share special relationships--if someone is your child, parent, or friend, you wouldn't treat them as you would a stranger. But is partiality justified, and if so, why? Partiality presents a theory of the reasons supporting special treatment within special relationships and explores the vexing problem of how we might reconcile the moral value of these relationships with competing claims of impartial morality. Simon Keller explains that in order to understand why we (...) give special treatment to our family and friends, we need to understand how people come to matter in their own rights. Keller first presents two main accounts of partiality: the projects view, on which reasons of partiality arise from the place that people take within our lives and our commitments, and the relationships view, on which relationships themselves contain fundamental value or reason-giving force. Keller then argues that neither view is satisfactory because neither captures the experience of acting well within special relationships. Instead, Keller defends the individuals view, on which reasons of partiality arise from the value of the individuals with whom our relationships are shared. He defends this view by saying that we must accept that two people, whether friend or stranger, can have the same value, even as their value makes different demands upon people with whom they share different relationships. EDUCERE is a government funded research and development project. EDUCERE objectives are to investigate, develop, and evaluate innovative solutions for society to detect changes in psychomotor development through the natural interaction of children with toys and everyday objects, and perform stimulation and early attention activities in real environments such as home and school. In the EDUCERE project, an ethical impact assessment is carried out linked to a minors’ data protection rights. Using a specific methodology, the project has achieved some promising (...) results. These include use of a prototype of smart toys to detect development difficulties in children. In addition, privacy protection measures which take into account the security concerns of health data, have been proposed and applied. This latter security framework could be useful in other Internet of Things related projects. It consists of legal and technical measures. Special attention has been placed in the transformation of bulk data such as acceleration and jitter of toys into health data when patterns of atypical development are found. I intend to argue that good friendship sometimes requires epistemic irresponsibility. To put it another way, it is not always possible to be both a good friend and a diligent believer.

There seems to be an interesting difference between judging someone to be good and judging them to be kind. Both judgements are typically positive, but the latter seems to offer more description of the person: we get a slightly more specific sense of what they are like. Very general evaluative concepts are referred to as thin concepts, whilst more specific ones are termed thick concepts. Examples of the former include good, bad, right and wrong, whilst there are countless examples of (...) the latter: brave, rude, gracious, wicked, sympathetic, mean. Marking this distinction opens up some interesting questions. How do the descriptive and evaluative elements of thick concepts combine? Are these elements separable in the first place? Is there a sharp division between thin and thick concepts? Can we mark interesting further distinctions between how thick ethical concepts work and how their aesthetic and epistemic counterparts work? How, if at all, are thick and thin concepts related to reasons and action?.These questions, and others, touch on some of the deepest philosophical issues about the evaluative and normative. They force us to think hard about the place of the evaluative in a (seemingly) nonevaluative world, and they also raise fascinating issues about how language works.This volume of twelve papers explores the phenomenon of thin and thick concepts. We prize loyalty in our friends, lovers and colleagues, but loyalty raises difficult questions. What is the point of loyalty? Should we be loyal to country, just as we are loyal to friends and family? Can the requirements of loyalty conflict with the requirements of morality? In this book, originally published in 2007, Simon Keller explores the varieties of loyalty and their psychological and ethical differences, and concludes that loyalty is an essential but fallible part of human life. I argue that there can be no such thing as a borderline case of the predicate ‘phenomenally conscious’: for any given creature at any given time, it cannot be vague whether that creature is phenomenally conscious at that time. I first defend the Positive Characterization Thesis, which says that for any borderline case of any predicate there is a positive characterization of that case that can show any sufficiently competent speaker what makes it a borderline case. I then appeal to (...) the familiar claim that zombies are conceivable, and I argue that this claim entails that there can be no positive characterizations of borderline cases of ‘phenomenally conscious’. By the Positive Characterization Thesis, it follows that ‘phenomenally conscious’ can not have any borderline cases. (shrink)

What is it for two people to think of an object, natural kind or other entity under the same mode of presentation (MOP)? This has seemed a particularly difficult question for advocates of the Mental Files approach, the Language of Thought, or other ‘atomistic’ theories. In this paper I propose a simple answer. I first argue that, by parallel with the synchronic intrapersonal case, the sharing of a MOP should involve a certain kind of epistemic transparency between the token thoughts (...) of the two thinkers. I then explain how shared words help bring about this transparency. Finally, I show how this account can be extended for thoughts expressed using demonstratives or indexicals. (shrink)

This book explores issues at the core of modern linguistics and cognitive science. Why are all languages similar in some ways and in others utterly different? Why do languages change and change variably? How did the human capacity for language evolve, and how far did it do so as an innate ability? Simon Kirby looks at these questions from a broad perspective, arguing that they can be studied together. The author begins by examining how far the universal properties of (...) language may be explained by examining the way it is used, and how far by the way it is structured. He then considers what insights may be gained by combining functional and formal approaches. In doing so he develops a way of treating language as an adaptive system, in which its communicative and formal roles are both crucial and complementary. In order to test the effectiveness of competing theories and explanations, Simon Kirby develops computational models to show what universals emerge given a particular theory of language use or acquisition. He presents here both the methodology and the results. Function, Selection, and Innateness is important for its argument, its methodology, and its conclusions. It is a powerful demonstration of the value of looking at language as an adaptive system and goes to the heart of current debates on the evolution and nature of language. (shrink)

While most large companies around the world now have a code of ethics, reported ethical malpractice among some of these does not appear to be abating. The reasons for this are explored, using academic studies, survey reports as well as insights gained from the Institute of Business Ethics' work with large corporations. These indicate that there is a gap between the existence of explicit ethical values and principles, often expressed in the form of a code, and the attitudes and behaviour (...) of the organisation. The paper suggests that two basic reasons appear to be at the heart of the problem: ineffective ethics programmes and deficiencies in corporate culture. The paper concludes that successfully embedded corporate ethical values requires well-designed ethics policies, sustained ethical leadership and incorporation of ethics in organisational processes and strategy as part of an ethical culture at all levels of the organisation. It makes some practical suggestions on how this can be achieved. (shrink)

You care about what others believe about you. What others believe about you determines whether you have a good reputation, whether you have the respect of your peers, and whether your friends genuinely like you. Your caring about others’ beliefs makes sense, because others’ beliefs bear directly upon your level of well-being. Your beliefs can influence others’ well-being, as much as their beliefs can influence yours. How your beliefs influence another’s well-being is a different matter from whether your beliefs are (...) supported by the evidence. Sometimes you can benefit another person by regulating your beliefs in response to considerations of her well-being, not of the evidence. Usually, you do not have strong reasons to regulate your beliefs in response to considerations of the interests of others. But it can be different when the person in question is your friend. Within some perfectly good friendships, the support that each friend provides for the other extends as far as their being willing to regulate their beliefs with the goal of benefiting the other, even if that makes it less likely that their beliefs will be supported by the evidence. Within our friendships, we then have reasons for belief that do not arise directly from, and sometimes compete with, reasons provided by evidence. This claim conflicts with the widespread Aristotelian view that good friendship is oriented to virtue. But it fits with a more plausible view about friendship, on which the function of friendship is to help us cope with the fact that we are not fully virtuous, and to serve needs that we have because we are not fully virtuous. This paper develops and defends a new account of B-theoretic endurantism and a new account of the metaphysics of the quantum state, and highlights the parallels between the considerations that motivate them. These new accounts are both fragmentalist, in the sense that they follow Fine (2005) in invoking a symmetric coordination relation between facts, such that facts that are pairwise incompatible (like Hugh's being happy and Hugh's being sad) can both obtain provided that they are not related by this relation. However, while Fine allows that fragments can be logically incoherent— P can obtain in one fragment while not-P obtains in another—the fragmentalist accounts defended here are motivated even if we insist on logical coherence between fragments.
